Retaining walls up to 1.5 metres are exempt from building consent as long as the wall isn't carrying any additional load beyond the soil it retains.

What counts as a surcharge

A surcharge is any additional load on top of the retained ground, most commonly a driveway, a building foundation, or a rising slope. A surcharge triggers consent regardless of height.

Rural zone exemption

In rural zones, the exemption extends to 3 metres of retained ground depth, provided the wall sits at least its own height away from any boundary or building.

Exempt doesn't mean unregulated

Even an exempt wall still has to comply with the Building Code, and may separately need resource consent depending on earthworks volume or boundary proximity.
